CONTRIBUTION (49) TO THE NATIONAL DEBATE WANTED BY THE PRESIDENT OF THE REPUBLIC IN 2020.

REFLECTION ON THE IMPOSSIBILITY OF THE CONTINUATION OF THE ORGANIZATION OF PUBLIC AUTHORITIES BY THE PREVALENCE OF ONE SEX OVER THE OTHER WHEN THE ECOLOGICAL EMERGENCY REQUIRES THE MOBILIZATION OF THE WHOLE POPULATION.

FROM THE EMERGENCY OF THE USE OF THE REFERENDUM TO CHANGE FROM COMPETITIVE PARITY TO PARITY OF LAW.

1) - The environmental referendum

On Sunday June 21, 2020, the Citizen Climate Convention submitted its report to the Minister of Ecological and Inclusive Transition.

This convention calls for a referendum to include the ecological emergency and the crime of ecocide in the Constitution.

Art. 11 of the Constitution provides for it in these terms:

"The President of the Republic ... may submit to a referendum ... on reforms relating to the nation's economic, social or environmental policy ...".

2) - Administrative policies

This convention was joined at the request of the President of the Republic. It installs the mobilization of the entire population as the determining element of the ecological emergency.

This imperative of mobilizing people in all their activities raises questions about the operating principles of administrative, public or private policies.

a- It is they who organize the association of people and their activities.

b- These policies combine the two sexes to infinity.

3) - Subordination from one sex to another

The Grenelle of violence against women (from September 3 to November 25, 2019), established two operating principles for administrative policies. And therefore of all administrations, public or private:

1- The Prime Minister has highlighted that men's violence against women is first of all the maintenance of administrative subordination of women to men; here in the domestic version of public administration.

2- The so-called Grenelle underlined the failure of the 1999 reform, called the Parity, based on the competition of the sexes, or competitive parity.

How to imagine mobilizing the whole population by a framework based on the infinite reproduction of the constitutional inferiority of one sex by the other?

4) - The parity referendum

It therefore appears impossible not to submit to the direct opinion of the French people the necessary reorganization of administrative policy based on the joint, legal, universal presence of both sexes in the formation and definition of public authorities and deliberative assemblies. It is legal parity.

This referendum is based on Article 11: "The President of the Republic ... may submit to a referendum any bill relating to the organization of public powers ..."

5) - Equality and parity

The debate on joint action between the two sexes has two parts:

a- Equality

It occurs where the sexes add up.

b- The parity

It imposes itself where the sexes overlap.

1- The principle of equality

Art. 1§1:

"France ... ensures equality before the law for all citizens ..."

Art. 3§4:

"Are electors, under the conditions determined by law, all major French nationals of both sexes ..."

Therefore, equality before the law of both sexes is already ensured.

In the current constitutional text, the distinction between the sexes in the relationship of citizens to the laws is already recorded.

They are full components of citizenship.

The distinction allegedly suffered by the "sexes" does not therefore arise from formal law.

2- The principle of parity

It could come from real law and the social practices it accompanies.

The grantor has already taken this difference into account in the operation of the law. This is the so-called parity function.

6) - Competitive parity

In 1999, this was enshrined in two articles of the Constitution:

1- Art. 1 § 2:

“The law promotes equal access of women and men to electoral mandates and elective functions, as well as to professional and social responsibilities. "

2- It is supplemented by Art. 4 § 2:

(The parties) “They contribute to the implementation of the principle set out in the second paragraph of article 1 under the conditions determined by law. "

a- Competition between the sexes is set up as a legal principle.

b- This competitive conception of parity has failed even for women in the ruling classes.

7) - Legal parity

Insofar as parliamentarians would like to take into account the failure of this reform of 1999, they would have to replace the device of competitive parity by the device of parity of law.

This requires that the equal participation of the two sexes concerns all women and ultimately all men.

8) - Proposal

Under cover of a refinement of the drafting, this would give:

1- Current

a- Art. 1, paragraph 2

“The law promotes equal access of women and men to electoral mandates and elective functions, as well as to professional and social responsibilities. "

b- Article 4, paragraph 2:

(Political parties) “They contribute to the implementation of the principle set out in the second paragraph of article 1 under the conditions determined by law. "

2- Register

a- Art.1, paragraph 2

Public authorities, deliberative assemblies, directorates and hierarchies of public services, de jure, de facto, by delegation or circumstances, are made up of the equal, joint, de jure, universal presence of both sexes.

b- Maintenance of Article 4, paragraph 2:

Obviously, the swinging husbands will lose their condé.

In the country, the French would find themselves united and efficient.

In Europe and in the world, the moral and political authority of women would be reinforced: that of France too.

DE L'URGENCE DU RECOURS AU REFERENDUM POUR PASSER DE LA PARITE CONCURRENTIELLE A LA PARITE DE DROIT.

1)- Le référendum écologiste

Le dimanche 21 juin 2020, la Convention citoyenne pour le climat a remis son rapport à la Ministre de la Transition écologique et solidaire.

Cette convention demande un référendum pour inscrire l'urgence écologique et le crime d'écocide dans la Constitution.

L'art. 11 de la Constitution le prévoit en ces termes :

« Le Président de la République...peut soumettre au référendum...sur des réformes relatives à la politique économique, sociale ou environnementale de la nation... ».

2)- Les politiques administratives

Cette convention a été réunie à la demande du Président de la République. Elle installe la mobilisation de toute la population comme l'élément déterminant de l'urgence écologique.

Cet impératif de la mobilisation des personnes dans toutes leurs activités conduit à s'interroger sur les principes de fonctionnement des politiques administratives, publiques ou privées.

a- Ce sont elles qui organisent l'association des personnes et leurs activités.

b- Ces politiques combinent les deux sexes à l'infini.

3)- La subordination d'un sexes à l'autre

Le Grenelle des violences faites aux femmes (du 3 septembre au 25 novembre 2019), a établi deux principes de fonctionnement des politiques administratives. Et donc de toutes les administrations, publiques ou privées :

1- Le Premier Ministre a mis en évidence que la violence des hommes à l'égard des femmes est d'abord l'entretien de la subordination administrative des femmes aux hommes ; ici dans la version domestique de l'administration publique.

2- Le dit Grenelle a souligné l'échec de la réforme de 1999, dite de la Parité, fondée sur la concurrence des sexes, ou parité concurrentielle.

Comment imaginer mobiliser toute la population par un encadrement fondé sur la reproduction à l'infini de l'infériorisation constitutionnelle d'un sexe par l'autre ?

4)- Le référendum de la parité

Il apparaît dès lors impossible de ne pas soumettre à l'avis direct du Peuple français la réorganisation nécessaire de la politique administrative à partir de la présence conjointe, de droit, universelle, des deux sexes dans la formation et la définition des Pouvoirs publics et des assemblées délibérantes. C'est la parité de droit.

Ce référendum se fonde sur l'art.11 : « Le Président de la République...peut soumettre au référendum tout projet de loi portant sur l'organisation des pouvoirs public... »

5)- Égalité et parité

Le débat sur l'action commune des deux sexes a deux volets :

a- L'égalité

Elle intervient là où les sexes s'additionnent.

b- La parité

Elle s'impose là où les sexes se chevauchent.

1- Le principe d'égalité

Art. 1§1 :

« La France ...assure l'égalité devant la loi de tous les citoyens... »

Art. 3§4 :

« Sont électeurs, dans les conditions déterminées par la loi, tous les nationaux français majeurs des deux sexes... »

Donc, l'égalité en droit des deux sexes est déjà assurée.

Dans le texte constitutionnel actuel l'indistinction des sexes dans le rapport des citoyens aux lois est déjà actée.

Ils sont constitutifs à part entière de la citoyenneté.

La distinction dont souffrirait les « sexes » ne provient donc pas du droit formel.

2- Le principe de parité

Elle pourrait provenir du droit réel et des pratiques sociales qu'il accompagne.

Le constituant a déjà pris en compte cette différence dans le fonctionnement du droit. C'est la fonction dite de la parité.

6)- La parité concurrentielle

En 1999, celle-ci est inscrite dans deux articles de la Constitution :

1- L'Art. 1 § 2 :

« La loi favorise l'égal accès des femmes et des hommes aux mandats électoraux et fonctions électives, ainsi qu'aux responsabilités professionnelles et sociales. »

2- Il est complété par l'Art. 4 § 2 :

(Les partis) « Ils contribuent à la mise en œuvre du principe énoncé au second alinéa de l'article 1er dans les conditions déterminées par la loi. »

a- La concurrence entre les sexes est érigée en principe juridique.

b- Cette conception concurrentielle de la parité a échoué même pour les femmes des classes dirigeantes.

7)- La parité de droit

Dans la mesure où les parlementaires voudraient prendre en compte l'échec de cette réforme de 1999, il leur faudrait remplacer le dispositif de la parité concurrentielle par le dispositif de la parité de droit.

Celle-ci impose que la participation égale des deux sexes concerne toutes les femmes et in fine tous les hommes.

8)- Proposition

Sous couvert d'un affinement de la rédaction, cela donnerait :

1- Actuel

a- Art. 1, alinéa 2

« La loi favorise l'égal accès des femmes et des hommes aux mandats électoraux et fonctions électives, ainsi qu'aux responsabilités professionnelles et sociales. »

b- Article 4, alinéa 2 :

(Les partis politiques) « Ils contribuent à la mise en œuvre du principe énoncé au second alinéa de l'article 1er dans les conditions déterminées par la loi. »

2- Inscrire

a- Art.1, alinéa 2

Les Pouvoirs publics, les assemblées délibérantes, les directions et hiérarchies de services publics, de droit, de fait, par délégation ou circonstances, sont constitués par la présence égale, conjointe, de droit, universelle, des deux sexes.

b- Maintient de l'Article 4, alinéa 2 :

Évidement, les maris battants perdront leur condé.

Dans le pays, les français se retrouveraient unis et efficaces.

En Europe et dans le monde, l'autorité morale et politique des femmes en serait confortée : celle de la France aussi.

THOUGHT ABOUT THE IRREGIATION PRODUCED BY THE INSTALLATION OF A SUBORDINATION OF DEMOCRACY IN DEFENSE OF THE RIGHTS OF A CRIMINAL AFFECTED TO CONTEST THE AUTHORITY OF THE GENDARMES WHICH POLITICALLY ENTERED INTO THE FILIATION OF REVOLUTIONARY FASCISM IN THE YEARS 30.

FOCUS ON THE CONFLICT OF THE VOYOUCRATIC PARTY WITH THE GENDARMES.

1- Adama Traoré is a common criminal. He had to submit to the gendarmes who had the right to control him during his escape and were under the obligation to arrest him.

2- The subordination of a citizen discussion, to the defense of the rights of a criminal to oppose the law and its representatives, is part of the lineage of pre-war revolutionary fascism or adventurous radical movements and bloody from the 70s.

3- It is staggering that these people have any aura or even some authority in the name of the pain of families in the parentage of typically mafia public cultures.

4- French democracy must regroup and start by showing its total solidarity with the gendarmes in this affair.

MISE AU POINT SUR LE CONFLIT DU PARTI VOYOUCRATIQUE AVEC LES GENDARMES.

1- Adama Traoré est un criminel droit commun. Il devait se soumettre aux gendarmes qui avaient le droit de le contrôler lors de sa fuite et étaient dans l'obligation de l'arrêter.

2- La subordination d'une discussion citoyenne, à la défense des droits d'un criminel de s'opposer à la loi et à ses représentants, s'inscrit dans la filiation des fascisme révolutionnaires d'avant-guerre ou des mouvements radicaux aventuriers et sanglants des années 70.

3- Il est sidérant que ces gens bénéficient d'une quelconque aura voire d'une certaines autorité au nom de la douleur des familles dans la filiation des cultures publiques typiquement maffieuses.

4- La démocratie française doit se ressaisir et commencer par marquer sa totale solidarité avec les gendarmes dans cette affaire.

REFLECTION (40) ON COMPENSATION FOR EXCESSIVE CONSEQUENCES OF LEGAL ACTIONS AND ON THE POLITICAL FUNCTION OF COMMUNITY LEADERS IN THE EXAMINATION AND EXPLOITATION OF THE OBSOLESCENCE OF COURT PROCEEDINGS.

PROPOSAL TO RESTORE THE MASTER OF THE STATE OVER JUDICIAL PROCEDURES;


The demonstrations which seize the occasion of the excessive consequences of legal actions of the police force multiply as well as their excesses.

It appears that the State has no legal procedure enabling it to control the political effects of these excessive and unforeseen consequences.

This obsolescence of the judicial procedures in force has led to an astonishing confrontation between the police and the Minister of the Interior. That is to say within the state.

Obviously, it is the ethno-religious political groups supported by an adventurous part of the political establishment who are leading the way.

However, as I have already explained, it is possible to:

1- Reclassify the main lines of these consequences.

2- Repair the wrongs thus made, without major costs for the Public Treasury.

3- Prevent the police from becoming political and judicial punching bags. 4- Let justice serve as a launching pad for the ambitious, the factious, and their policies of national division.

It is pitiful to see:

1- Police officers and gendarmes broken for legally exercising their public order function.

2- Judges play the watch knowing that they will have to leave the proceedings and the court from time to time in the hands of the families of criminals.

3- Statesmen sympathize at the bedside of an offender thus injured without meeting the police charged for a crime that does not exist.

I realize that no one has proposed anything relevant to this subject. I therefore take the liberty of recalling my reflections on this subject.

REFLEXION (40) SUR L'INDEMNISATION DES CONSEQUENCES EXCESSIVES DES ACTIONS LEGALES ET SUR LA FONCTION POLITIQUE DIRIGEANTE DES COMMUNAUTAIRISTES DANS L'EXAMEN ET L'EXPLOITATION DE L'OBSOLESCENCE DES PROCEDURES JUDICIAIRES EN COURS.

PROPOSITION POUR RETABLIR LA MAITRISE DE L'ETAT SUR LES PROCEDURES JUDICIAIRES ;

Les manifestations qui saisissent l'occasion des conséquences excessives d'actions légales des forces de l'ordre se multiplient ainsi que leurs dérives.

Il apparaît que l'Etat ne dispose d'aucune procédure légale lui permettant de maîtriser les effets politiques de ces conséquences excessives et imprévues.

Cette obsolescence des procédures judiciaires en vigueur a conduit à un stupéfiant affrontement entre les forces de l'ordre et le Ministre de l'intérieur. C'est à dire au sein de l’État.

Visiblement, ce sont les groupes politiques ethnico-religieux soutenus pas une partie aventureuse de l’establishment politique qui mènent le bal.

Or, comme je l'ai déjà exposé, il est possible de :

1- Reclasser les lignes de force de ces conséquences.

2- Réparer les tords ainsi faits, sans frais majeurs pour le Trésor public.

3- Empêcher que les forces de l'ordre deviennent des punching-ball politiques et judiciaires. 4- Que la justice serve de rampe de lancement pour les ambitieux, les factieux, et leurs politiques de division nationale.

C'est pitié de voir :

1- Des policiers et des gendarmes brisés pour avoir exercé légalement leur fonction d'ordre public.

2- Des magistrats jouer la montre en sachant qu'ils devront par équité laisser de temps à autre la procédure et le tribunal aux mains des familles de criminels.

3- Des hommes d'Etat compatir au chevet d'un délinquant ainsi blessé sans rencontrer les policiers mis en examen pour un crime qui n'existe pas.

Je m'aperçois que personne n'a proposé quoi que ce soit de pertinent à ce sujet. Je me permets donc de rappeler mes réflexions à ce sujet.

REFLECTION ON THE SUBVERSION OF THE STATE BY THE MIGRATORY AVANT-GARDES AND ON THE POPULAR BENEFITS OF THEIR ACTIONS.

THE REASON FOR WHICH THE DOG LIGHTS THE POWER OF THE STATE AND THE FRENCH


Following the racial conflicts between Arabs and Chechens in Dijon, the deputy Eric Ciotti declares on June 16, 2020: "We cannot let this gang war flourish (…) a doglit which is becoming generalized."

These gangs and their Islamist or political outgrowths are ethnico-religious. They are there in the first place where the populations which feed them are dominant.

These are preponderant because the elected representatives and the heads of administrations concerned (in particular the prefects and the Mayors) accompany for thirty years, the ethnico-religious party in its diversity in its conquest of the territorial, human and political space, that are the HLM Cities and from there towards certain hegemonies.

The subversion of the state is now blatant.

a- It is no longer recognized as the benchmark for public order. Conflicts are settled at the nearby Mosque and this conclusion is binding on the law.

b- We want to impose as a public standard the fascism of political support for gangsters against the national forces of the gendarmerie and the police.

For simplicity ; at each car fire by the ethnico-religious vanguards, the beneficiaries of housing (landlords, prefects, municipalities) replaced, first and foremost, the French fleeing this unleashing of racist hatred and servitude, by the populations corresponding to these avant-garde.

Without the intersection of interests of these two forces, there would be no "lost territories of the Republic"; at least in the most complete helplessness of the French.

This meeting created the sinister ideological farces which are discrimination or anti-racism.

The “discriminated”, the “racialized”, thus obtained privileges, priorities, exclusivities, facilities, collusion, accommodation, in housing, employment (notably public, even exclusivity in so-called Muslim companies), trade credit (cf. Qatar supplemented by the State), education (see privileges of tutoring and access to Grandes Ecoles), and so on.

a- The famous "ghettos" are conquered cities and presented as places of "relegation". b- The most beautiful accommodation in the world becomes concentration camps.

This legend thus makes it possible to claim the conquest of new territories, part of which will become new "ghettos" giving right to new conquests and another part, (notably for the community bourgeoisie), will become the discrete enclaves whose denunciation is prohibited. racial closure on pain of racism.

One of the aspects of public order is therefore to relocate the French; both in employment and in housing, trade credit, school curriculum, and so on.

Do French elected and administrative executives still have the capacity, if only personal?

As part of the commemorations of June 18, 1940, we can say: Wait and see.

DE LA RAISON POUR LAQUELLE LA CHIENLIT ILLUMINE L'IMPUISSANCE DE L'ETAT ET DES FRANCAIS


A la suite des conflits raciaux entre Arabes et Tchétchènes à Dijon, le Député Eric Ciotti déclare le 16 juin 2020 : «On ne peut pas laisser prospérer cette guerre des gangs (…) une chienlit qui se généralise.»

Ces gangs et leurs excroissances islamistes ou politiques sont ethnico-religieux. Ils sont là en premier lieu où les populations qui les alimentent sont dominantes.

Celles-ci sont prépondérantes parce que les élus et les chefs d'administrations concernés (notamment les préfets et les Maires) accompagnent depuis trente ans, le parti ethnico-religieux dans sa diversité dans sa conquête de l'espace territorial, humain et politique, que sont les Cités HLM et de là vers certaines hégémonies.

Désormais, la subversion de l’État est flagrante.

a- Celui-ci n'est plus reconnu comme la référence de l'ordre public. Les conflits se soldent à la Mosquée du coin et cette conclusion s'impose au droit.

b- On veut imposer comme norme publique le fascisme du soutien politique aux gangsters contre les forces nationales de la gendarmerie et de la police.

Pour faire simple ; à chaque incendie de voitures par les avant-gardes ethnico-religieuses, les attributaires de logements (bailleurs, préfets, communes) ont remplacé, prioritairement et massivement, les français fuyant ce déchaînement de haine raciste et de servitude, par les populations correspondant à ces avant-gardes.

Sans les croisements d'intérêts de ces deux forces, il n'y aurait pas de « territoires perdus de la République » ; du moins dans la plus complète impuissance des français.

Cette rencontre a créé les farces idéologiques sinistres que sont la discrimination ou l'antiracisme.

Les « discriminés », les « racisés », ont ainsi obtenu des passe-droits, des priorités, des exclusivités, des facilités, des connivences, des accommodements, dans le logement, l'emploi (notamment public, voire l'exclusivité dans les entreprises dites musulmanes), le crédit commercial (cf. le Qatar complété par l’État), l'éducation (voir les privilèges de cours de soutien et d'accès aux Grandes écoles), et ainsi de suite.

a- Les fameux « ghettos » sont des cités conquises et présentées comme des lieux de « relégation ». b- Les plus beaux logements du monde deviennent des baraquements concentrationnaires.

Cette légende permet ainsi de revendiquer la conquête de nouveaux territoires dont une partie deviendront de nouveaux « ghettos » donnant droit à de nouvelles conquêtes et une autre partie, (notamment pour la bourgeoisie communautaire), deviendra les enclaves discrètes dont il est interdit de dénoncer la fermeture raciale sous peine de racisme.

L'un des aspects de l'ordre public est donc de relocaliser les français ; tant dans l'emploi que dans le logement, le crédit commercial, le cursus scolaire, et ainsi de suite.

Les cadres élus et administratifs français en ont-ils encore les capacités, ne serait-ce que personnelles ?

Dans le cadre des commémorations du 18 juin 1940, nous pouvons dire : Wait and see.

CONTRIBUTION (45) TO THE NATIONAL DEBATE WANTED BY THE PRESIDENT OF THE REPUBLIC IN 2020.
REFLECTION ON THE FASCIST POLITICAL QUALITY OF THE DIRECTION OF THE MOVEMENT OF ANTI-RACIST MOBILIZATIONS AGAINST POLICE VIOLENCE, FOR JUSTICE, FROM 2 AND 6 JUNE 2020.

THE REFUSAL OF THE FASCIST DIRECTION OF A LEADING PARTY OF THE FRENCH SOCIAL AND POLITICAL MOVEMENT AND THE HUMILIATION OF BEING TAKEN FOR A Fool in his own country.


1) - Qualification
The rallies of June 2 and June 6, 2020 (for justice, against police violence and racism) are held in memory of Adama Traoré, the criminalization of the gendarmes who arrested him, and in initiative of Assa Traoré, his sister.

This means that the direction of this political action subordinates democratic action to the political alliance with gangsterism. It is a fascist political leadership.

The revolutionary fascism with which this political leadership is affiliated is customary in combating social injustices, state oppression, unbearable discrimination, etc.

The predecessors of these organizations were the Croix-de-feu, Action française, Camelots du Roi, the French People's Party, the Charlemagne division, etc. have nothing to envy their successors in these matters and in the defense of justice and so on.

1- The 2005 uprising was the finalization of the local sovereignty acquired by these movements.
2- The Bataclan massacre is the announcement of the end of the subordination of these movements to the university policy of the ideological separation of the "suburbs" and the "capital".
For them, it is an arm of honor given to the so-called “peripheral” ideology and the demand for their installation in places of Power.
3- June 2 and 6 are the declared will for public recognition of their constitute role in the state.
4- In all cases, the political leadership includes common rights.

In the immediate term, fascism aims this time to impose on France a policy of national division expressly aimed at a right of precedence, the particular territorial organization of certain populations, as well as the enslavement of the French and public space with the uncle-macouts of thugs and preachers of religious dictatorships.

2) - The joke
1- A very common joke would like that the blacks of the United States or the Antilles (all the blacks of the colonies) and the Africans are brothers having suffered similarly from the slavery of the Europeans.
a- On the one hand, the famous anti-slavers never cite Arab slavery, the more important of the two and above all, that which has never stopped or been prohibited by the interested parties.
b- On the other hand, the West Indians and the African-Americans are actually descendants of slaves.
c- But Africans are descendants of slavers.
It was the Africans who created the slaves, gathered them and led them to the ports where European slave traders awaited them.

2- Barack Obama is not a descendant of slaves but of slavers.
a- A Muslim family from Kenya can only be linked by its ancestry to the conquest of African populations in order to deliver them into slavery to the Arabs.
b- It is moreover very likely that it is this exteriority to the ancestral ideologies of African-Americans that gives Barack Obama this ease in his discussions with white Americans.

3) - Participation
The discussion can be democratic and outside this tutelage of fascist ideologies. Everyone must contribute.

Here is a reflection on the current legal proceedings concerning the subject:
1- A possible obsolescence of certain provisions of the criminal procedure
a- It ignores the classification of excessive consequences of justified legal actions and the distinction between their reparation and the search for possible administrative and criminal responsibilities as regards the occurrence of these consequences.
b- It confuses the repair of wrongs caused to the citizen with the conviction of the official.
2- A submersion of the procedure
This confusion must have worked in the past in accordance with public order.
To take a computer image, it is today a viral gateway.
It is on the basis of this uniqueness, or this comprehensiveness, of the qualification of the facts and of this confusion of the criminal proceedings and reparation, that the factional groups gradually come to
to exercise a directing function on the functioning of the procedure and in the definition and the implementation of the activity of the public authorities.
No offense to the pride of state officials.
3- Whatever the qualification used for these public actions, they cannot lead to the return of the old order or allow it to adapt to the factious conception of evolution.

This is only a one-off contribution to understanding this complexity.

4) - Conclusion
The French should raise an eyelid about this grip of fascism on a decisive part of the French political debate. In France, this goes hand in hand with the defeat of the country and its disappearance.

The democracy created two centuries ago by the Revolutions (English, American, French, Corsica, etc.) is still the alpha and omega of the development of society.

DU REFUS DE LA DIRECTION FASCISTE D'UNE PARTIE DIRIGEANTE DU MOUVEMENT SOCIAL ET POLITIQUE FRANCAIS ET DE L'HUMILIATION D'ETRE PRIS POUR UN IMBECILE DANS SON PROPRE PAYS.


1)- La qualification
Les rassemblements du 2 juin et du 6 juin 2020 ( pour la justice, contre les violences policières et le racisme) se font au titre de la mémoire d'Adama Traoré, de la criminalisation des gendarmes qui l'ont arrêté, et à l'initiative d'Assa Traoré, sa sœur.

Cela signifie que la direction de cette action politique subordonne l'action démocratique à l'alliance politique avec le gangstérisme. C'est une direction politique fasciste.

Le fascisme révolutionnaire auquel s'affilie cette direction politique est coutumier des combats contre les injustices sociales les oppressions de l’État, les insupportables discriminations, etc.

Les prédécesseurs de ces organisations que furent les Croix-de-feu, Action française, les Camelots du Roi, le Parti populaire français, la division Charlemagne, etc. n'ont rien à envier à leurs successeurs en ces matières et dans la défense de la justice et tutti quanti.

1- Le soulèvement de 2005 était la finalisation de la souveraineté locale acquise par ces mouvements.
2- Le massacre du Bataclan est l'annonce de la fin de la subordination de ces mouvements à la politique universitaire de la séparation idéologique des « banlieues » et de la « capitale ».
C'est pour eux un bras d'honneur fait à l'idéologie dite du « périphérique » et la revendication de leur installation dans les lieux de Pouvoir.
3- Les 2 et 6 juin sont la volonté affichée d'une reconnaissance publique de leur rôle constituant dans l’État.
4- Dans tous les cas, la direction politique inclut les droits communs.

Dans l'immédiat, le fascisme vise cette fois-ci à imposer à la France une politique de division nationale visant expressément à un droit de préséance, d'organisation territoriale particulière de certaines populations, ainsi qu'à l'asservissement des français et de l'espace public aux tonton-macoutes des voyous et des prêcheurs des dictatures religieuses.

2)- La plaisanterie
1- Une plaisanterie fort courante voudrait que les noirs des Etats-Unis ou des Antilles (tous les noirs des colonies) et les africains soient des frères ayant souffert pareillement de l'esclavage des européens.
a- D'une part, les fameux anti-esclavagistes ne citent jamais l'esclavage arabe, le plus important des deux et surtout, celui qui n'a jamais cessé ni été interdit par les intéressés.
b- D'autre part, les antillais et les afro-américains, sont effectivement des descendants d'esclaves.
c- Mais les africains sont des descendants d'esclavagistes.
Ce sont les africains qui ont créé les esclaves, les ont rassemblés et conduits dans les ports où les attendaient les négriers européens.

2- Barack Obama n'est pas un descendant d'esclaves mais d'esclavagistes.
a- Une famille musulmane du Kenya ne peut qu'être liée par son ascendance à la conquête de populations africaines afin de les livrer en esclavage aux Arabes.
b- Il est d'ailleurs fort probable que ce soit cette extériorité au idéologies ancestrales des afro-américains qui donne à Barack Obama cette aisance dans ses discussions avec les blancs américains.

3)- Participation
La discussion peut être démocratique et hors de cette tutelle des idéologies fascistes. Chacun doit y contribuer.

Voici une réflexion sur les procédures judiciaires en cours concernant le sujet :
1- Une possible obsolescence de certaines dispositions de la procédure pénale
a- Elle ignore la qualification de conséquences excessives d'actions légales justifiées et la distinction de leur réparation et de la recherche des responsabilités administratives et pénales possibles quant au surgissement de ces conséquences.
b- Elle confond la réparation des tords causés à l'administré avec la condamnation du fonctionnaire.
2- Une submersion de la procédure
Cette confusion a dû fonctionner autrefois conformément à l'ordre public.
Pour prendre une image informatique, elle est aujourd'hui une porte d'entrée virale.
C'est à partir de cette unicité, ou de cette globalité, de qualification des faits et de cette confusion de la procédure pénale et de la réparation, que les groupements factieux en viennent progressivement à
exercer une fonction dirigeante sur le fonctionnement de la procédure et dans la définition et la mise en œuvre de l'activité des pouvoirs publics.
N'en déplaise à l'orgueil des cadres de l’État.
3- Quelque soit la qualification retenue pour ces actions publiques, elles ne peuvent conduire au retour de l'ordre ancien ni laisser celui-ci s'adapter à la conception factieuse de l'évolution.

Ceci n'est qu'une contribution ponctuelle à la compréhension de cette complexité.

4)- Conclusion
Les français devraient lever une paupière quant à cette mainmise du fascisme sur une partie déterminante du débat politique français. En France, celui-ci va de pair avec la défaite du pays et sa disparition.

La démocratie crée il y a deux siècles par les Révolutions (anglaise, américaine, française, Corse, etc.) est toujours l'alpha et l'oméga du développement de la société.

CONTRIBUTION (44) TO THE NATIONAL DEBATE WANTED BY THE PRESIDENT OF THE REPUBLIC IN 2020.
REFLECTION ON THE PRESENCE OF TWO SEXES, BOTH FORMS, THE REFORM OF THE CONSTITUTION. (Continuation of reflection n ° 43 of May 19, 2020 and previous. Cf.: madic50.blogspot.com)

TO RECOGNIZE THE PRESENCE OF THE LAW OF BOTH SEXES AND END THE MASCUNLINE CHARITY TOWARDS WOMEN.

Chapter 1: A State Affair

1) - Le Grenelle
On September 3, 2019, in his opening speech of the assembly of feminist leaders known as “the Grenelle of violence against women”, the Prime Minister, Edouard Philippe, noted the link that there is between the social processes of domination men on women and so-called domestic violence.

For this, he takes up the question of an abused woman:
"One of our fellow citizens, Christine, writes me that she is wondering" where is the justice ". And that she finds "this justice of men unacceptable".
He places the answer under the responsibility of the governments:
“Christine's question is unsustainable, for each of our fellow citizens, and more particularly for those, including myself, who are responsible for finding solutions. "

2) - The two emergencies
At this Grenelle, the Prime Minister addresses two emergencies:

1- The technical emergency
It responds to the urgency of the moment. It is about protecting the flight of abused women.
"The first emergency is to protect women who are victims of domestic violence by providing them with rapid shelter."
This meeting will therefore have had the merit of taking such measures.
2- The institutional emergency
But, through his examples and comments, the Prime Minister tells us that Christine's question requires the state to respond to another emergency.
a- This dates from before the invention of emergency accommodation:
“For centuries, these women have been buried under our indifference, our denial, our carelessness, our age-old machismo, our inability to face this horror in the face. "
b- It relates to the organization of the company:
"Because marital violence is not a dispute between couples where the wrongs are shared: it is a process of sexist control, so ingrained in our mentalities and our practices that some men have become used to impunity. "
c- It calls for a change in the policy of institutional frameworks.
"The government is fully mobilized, but we need you, your expertise as an association, a parliamentarian, a local elected official or a professional on the ground, whether you are a police officer, gendarme, magistrate, social worker, doctor, teacher, head of a shelter, mayor. Because our responsibility is collective, work must be collective. "
d- It requires a radical change:
"It is at this price that this Grenelle will be able to radically change things"

3) - The reality of the law
Christine is not confronted with an isolated moron but with an authority which benefits from "the justice of men"
This inclusion in the functioning of "justice", that is to say in the force of law, has the primary effect of placing women outside the law at home.

A woman can be “chased away, by an alcoholic and violent spouse, from her home” because, even if she owns the apartment, “men's justice” legitimizes the occupation of the premises by the man and disqualifies the rights of women occupying the premises.

4) - The preponderance
a- The present
As much as the criminal cretinism of such people, it is also the respective legal position of men and women that these violence renews.

The reason why "justice" is that of "men" is that the legal, constitutional authority ultimately recognizes the legal preponderance of men over women.

It happens, often well, frequently moderately, sometimes very badly.

b- The future
The Prime Minister indicates that the radicality of collective action is part of the answer: “Because our responsibility is collective, work must be collective. It is at this price that this Grenelle will be able to radically change things ”

This radicalism must first restore order to the law by formulating that it is up to the violent to leave the scene and not to the battered and the children to seek refuge.

5) - The place of the debate
The Grenelle of violence against women certifies to us that the democratic progress of social relations between the two sexes is not stable, even lasting, as long as the legal question of “justice of men” is not tackled and has not received the first decisive responses.

The place for this debate is the electoral system.

This is where women have publicly installed themselves as equals with men in society.

This achievement made it possible to give a public, political form to the debate on the administrative inequality of the two sexes.
The administrations, public or private, can do without women and not men.

6) - The Jospin reform
The first reform which tackled this question, in 1999, on the initiative of Prime Minister Lionel Jospin, had the merit of having opened the breach in the legal domination of one sex over the other.

However, it maintained the legitimacy of gender inequality by transforming dominance into precedence. She moved the question. She did not answer it.

Art. 1, §2: “The law promotes equal access of women and men to electoral mandates and elective functions, as well as to professional and social responsibilities. "

Art. 4, §2: “(the parties) They contribute to the implementation of the principle set out in the second paragraph of article 1 under the conditions determined by law.

The "law", the "parties", are already there. They are responsible for doing something to integrate women who are outside into the institutional game which they have naturally led for a long time. And this, while no rule has changed. In fact, "favoring" is not a legality.

What can they give other than the perpetual renewal of preponderance, or precedence, of men?

7) - The two Parities

1- Competitive parity
The Jospin reform can be called competitive parity since it puts the sexes in competition for the positions to be filled

2- Legal parity
So what is needed is to move to legal parity.
Both sexes are present by right where they are organized.

The following discussion is devoted to the study of this reform.

Chapter 2: Legal parity

8) - Elections and gender
Elections are only possible because the two sexes are the only actors in the vote.
The formal equality of the two sexes, their lack of distinction in the electorate and the ballot, is therefore the only reality to be taken into account in an electoral procedure.

9) - Human sovereignty
The primary function of modern elections is to act that men are the only ones to decide for themselves.
Extra-humans can inspire them, they cannot decide for them.
The election is humanity which expresses its sovereignty.
Thus, at the same time that he destroyed the order of the Templars and that he bent the Pope, King Philippe Le Bel convened the first assembly of the States-General; women are "summoned".
Consequently, the chief executive has the monopoly on the legitimacy to say the just and the State will become the producer of the justifications on which he bases his own decisions. cf. Wikipedia.
There is no election if there has not previously been the eviction of extra-humans from the field of the organization of public authorities.

10) - The certificate of humanity
The principle of voting refers to society. It is the place of its political creation.
When the vote takes the form of universal suffrage, it acquires the capacity to define humanity.
Men being alone in the management of public powers, the question therefore arises of the definition and the delimitation of humanity.
You have to know who is going to vote.
The arrival to vote of both sexes is inevitable from the moment when the right to vote is a control and a certificate of humanity.

That is why all electoral systems have passed to universal suffrage and gender equality. Censorial and monosexual suffrage can only be in this context a particular and untenable sequence of universality.

11) - The glass ceiling
The formal equality of the two sexes in the right to vote settled from the end of the 19th century.

Leaving the limbo of the heroic conquest of a right, the formal equality of the two sexes confronted with its consequences can appear to bring the proof of its inanity.

Indeed, the formal equality of the two sexes during an election invariably produces a real inequality of the two sexes in the results of the vote. The male sex is overwhelmingly majority among the elected.

12) - Indistinction
The method of equality is indistinction.
The indistinction of the two sexes signifies their joint presence.
Their distinction makes possible the absence of one or the other.
The voters are identical to the voters and the two merge in the same voting procedure.
On the other hand, when the elected representatives are systematically men, and we know that the massive presence of women is due only to obligations outside the vote, this raises questions.
If we think that elected officials are the product of equality, of the sovereign choice of equal persons, and that the candidacies of both sexes are free, then the fact of this male domination in the results of the vote calls into question real equality of both sexes.
One is clearly seen by both to be more capable than the other.
The choice is free, so it's an appreciation. It is widely shared.
Equal voting questions the equality of the capacities of both sexes to exercise public responsibilities, including that of voting.
What the media call the "glass ceiling" also presents itself as a capacity ceiling.

13) - Uncertainty
This is so because the concept of equality of the two sexes imposes its obviousness but it does not say which.
There are two sexes, they are equal, they vote without distinction; is.
But what does equality produce in the entire course of the election?
I am a voter, I vote.
But the question of equality arises at what time of the vote and its consequences?
a- Voters are individuals and a collective. They are the voters or the electorate.
b- Elected officials are individuals and a collective. They are elected or members of an assembly.
c- Where does equality stand, in the composition of individuals or in that of collectives?
How does it fit?

14) - The two sectors
Why was a distinction within the same "cause", that of equality, imposed in the governance of States?
a- Equality goes without saying for electoral lists.
b- It becomes complicated, even insoluble, for the composition of elected groups, therefore assemblies.

This "cause" includes logical breaks that we call here "sectors". They impose their practical consequences.

Sector 1 is equality. Equality is the addition of the two sexes.
Sector 2 is parity. Parity is the presence of equal rights of two sexes.

Sector 1:
It applies to all legal situations where male unity can be doubled with female unity.
Women can be wherever the administrative, organizational unit can be dual.
The duplication allows the equality of the sexes by their presence in the double.
The presence of women satisfies the ideology of the complementarity of the two sexes.
This right is constructed, it is equality: in this case of the two sexes.

Sector 2:
It applies to all legal situations where the unit cannot be split.
Women cannot be where unity is one because space is already taken.
In these circumstances, women can be next to men. They cannot be in their place.
The uniqueness of the function breaks with the complementarity and presents women as spoilers, predators, expropriators.
This uniqueness of the occupation of a place modifies the functioning of the principle of equality.
This principle becomes parity.
If there is a need for parity then it is that there are fields where the unit cannot split.

15) - The two forms
Voting and its result, equality and parity, therefore belong to two distinct social structures; the questions and the answers are different.

These realities that concern us here belong to two intertwined, even fusional, but distinct forms. cf. The two forms, ed. Amazon.
1- The economic form:
a- It governs socio-economic structures. It produces states and civil society: politics, law, philosophy, citizenship, elections, rationality, etc. Equality like inequality, freedom like slavery, economic systems, etc., are conceivable.
b- It is the shape of large or small human masses, majorities and minorities.

2- The administrative form
a- The administrative form is the infinite combination of the two sexes, the 1-0 of IT or the 1-2 of social security.
b- The first ruling administrative ideology was religious ideology. It imposed its total logics until the invention of secularism.
c- The religious ideology rests on two pillars: the extrahumans and the subordination of the woman to the man.
d- It functions by the fabrication of the individual and of the whole.

3- Reports of the two
The relationship from one form to another can be clarified by the description of the fascia and its role:
"A fascia is:
a- A fibro-elastic membrane which covers or envelops an anatomical structure.
b- It is made up of connective tissue very rich in collagen fibers.
Fascias are known to be passive structures for transmitting stresses generated by muscle activity or forces external to the body.

4- The election is a political act (the masses, the law) which intervenes in an administrative structure (the 1-2) and imposes the equality of citizens and sexes in this space where secular religious influence made it impossible in this provision.

16) - The whole
According to the administrative language of totality and individuality; the path of universal suffrage defines humanity as being a genetic whole.
It is made up of two sexes and nothing else.
Becoming a vote of both sexes, the election manifests its administrative form which is the infinite combination of the two sexes; the whole and the individual.

1- On the one hand, the totality reached an equal distribution of the two sexes for the elections.
2- On the other hand, it produces a discriminating elective distribution of both sexes

17) - Logics
This is so because the particular administrative logic of the electorate is organized by politics.

The latter got rid of extra-human ideologies and sexual dominions called otherwise religious which always organizes the administrations of candidates and assemblies of elected officials.

The particular logic of deliberative assemblies is indeed always shared between:
a- Political principles, that is to say equality and the exclusion of extra-human ideologies in the exercise of its political functions. The political or economic form conditions political groups and the passing of laws.
b- The principles of these same ideologies in its administrative composition. In the individual reports of all their members, the assemblies retain a distinction between the sexes.
It is not compulsory for the ordinary, administrative functioning of the assemblies that both are present.

In other words :
1- Politically, the deliberative assemblies are citizens and egalitarian; at least virtually.
2- Administratively, the same assemblies reproduce the religious base of the domination of men over women and the inferiority of these.

18) - The discontinuity
Citizens may have the impression that universal suffrage will (even gradually) bring about an identical gender distinction among elected officials as among voters.

In fact, there is no administrative continuity between the electorate, or electoral body, and the electivity, or body of elected officials.
1- When an elector enters a polling station, he is in a high place of administrative form.
However, the latter's ideology of function comes from the economic form via politics. This place operates gender equality, of citizens.
2- When he puts his ballot in the envelope then in the ballot box, he does not vote in the continuity of the electoral administration where he is.
3- It intervenes in a sector of the administrative form which is distinct from the electorate and which still ensures the primacy of the ancestral ideologies of relations of the two sexes.
4- I call it electivity or elective totality.
5- It is made up of the candidacy administrations, elected officials, groups of elected officials.



19) - The break
There is, even within the polling station, the expression of a break in continuity between the electorate and the electivity.

This break in continuity begins with the candidates and the administration of the candidates. Men are more likely to be elected first because they are more likely to run and be introduced.

This is because the candidates and candidacies are from the same particular administrative sector as the elected officials and electives. They are part of the same continuity.

This discontinuity between the electorate and the elective bloc is twofold:
1- It is objective in the sense that the two activities are distinct and give rise to different logics.
2- It is logical in the sense that:
a- One of the administrations is governed by political logic.
b- The other is governed by the administrative logic still subject to the ideology of distinction between men and women.

It shows the progressiveness of secularization, politicization, of the administrative form whose first public ideology was religion.

In all countries of the world, the equality of the two sexes was first of all the indistinction within the electorate accompanied by the eligibility of women and by certain rules of law allowing the formal equality of the two sexes.

Outside the polling station, there is no salvation for equality and the presence of rights of both sexes.

20) - The solution
The equality of the two sexes therefore does not fail to impose the indistinction of the sexes in the administrative branch of electivity.

The absence of women in the assemblies, their small number, their powerlessness to really modify the social relations between the sexes, does not stem from the incapacity of this sex.

Electivity is governed by mechanisms separate from those of the electorate.

It is therefore by removing the effects of these principles on electivity (candidates and elected officials) that the indistinction of the two sexes can be found in assemblies.
1- For the training of the electorate, politics has replaced archaic ideologies. It imposed equality of the sexes which we forget too quickly that it was not self-evident.
2- For the formation of electivity, this operation is to come.
Politics must impose, not the equality of the sexes which is already acquired, but the indistinct presence, of right, of the two sexes.

21) - Individual and totality
The question then arises of the adequacy of the two singular administrative forms; the electorate and the electivity.

One cannot understand the mechanisms of universal suffrage without distinguishing the individual and the whole.

Voters do not exist without the electorate.
Applicants do not exist without the application.
Elected officials do not exist without electivity (candidates and elected officials)

The electorate is made up of the gender distinction.
Its organization is prior to voting.
However, each voter votes according to their own judgment and by secret ballot.

The candidacy is a totality, an administration, informal managed by multiple forces.
The candidate is the product of the application but it is unique.

The electivity is made up of a multitude of groupings which therefore constitute a legal force for its members.
Contrary to the electorate, electivity only takes on its meaning after the election.
The candidate is the caterpillar, the chosen one is the butterfly.

In summary
a- The equality of the two sexes is valid for the composition of the electorate. The list of electors is common.
b- This equality therefore ensures the right of each citizen to vote in the same way as any other.
c- On the other hand, it does not ensure the indistinction of the vote of each voter. These votes are specific and secret.
d- The equality of presence of elected representatives applies to the composition of electivity. The presence of elected representatives of both sexes is equal.
e- For the electorate, equality is a precondition for voting. The voters' indistinctness defines the electorate.
d- For electivity, the device is distinct.
e- Elected officials organize their presence in accordance with the rules of equal presence of both sexes.

22) - What to do?
The legal principles of gender equality apply only to the whole and not to individuals.

1- Gender equality in elections is not a matter for the voters but for the administrative organization of the electorate.
a- A voter is not a voter. She is unique.
b- The equality ratio only concerns the membership of one and the other in totalities such as the sexes and the electorate.
2- The equality of presence of the two sexes in the assemblies, known as parity, does not depend on the choice of the voters but on the legal organization of the electivity.
3- Gender equality for elected officials cannot be prior to the election. It is the equal presence of the elected representatives of both sexes in the assemblies; after the election.
4- The law must therefore provide that:
a- The assembly, in the capacity of elected officials, organizes the equal presence of elected representatives of both sexes in the assembly.
b- This parity in the assembly requires that the administration of candidates prepare candidates of both sexes.
c- The electoral administration organizes the vote in such a way that the assembly of elected officials can organize there the equal presence of both sexes.

23) - The parties
The entire candidate administration was officially named as such by the constitutional reform of 1999. These are the political parties.
In France, at the end of the constitution, since the joint reform of 1999, the parties are the representatives of the elective administration:
Article 4:
paragraph 1: "Political parties and groupings contribute to the expression of suffrage ..."
paragraph 2 “They contribute to the implementation of the principle set out in the second paragraph of article 1 under the conditions determined by law. "
There is nothing to change.

The parties constitute the elective whole:
1- The candidates only present themselves to the voters, and do not stay between two rounds, except by the acceptance or the will of the parties.
2- Assemblies accompany the equal presence of elected representatives of both sexes only through political groups.

24) - Individual freedom
The obligation of equal presence of the two sexes which is made with the assemblies does not oppose the free will of the voters.

Voters vote for the candidates of their choice, whose candidacy complies with the rules of suffrage and in the forms provided by law.

On the one hand, these candidates are nominated, by the parties or by groups.
On the other hand, when voters vote for lists, when the law provides for mixing, when candidates call to vote for another in the second round, or when a candidate misses his registration, etc.

In all these cases where the voters' free will is void, no one declares that their freedom to vote is legally distorted.

The presentation of such and such a candidate for voting does not depend entirely on the voters. These are routes completely independent of the election.

The elector's sole function is to vote, in secret, for one of the candidates whose ballot papers are presented to him on the table at the polling station.

25) - The proposal
I therefore propose to reform the Constitution as follows:
1- Delete:
Art. 1, paragraph 2
The law promotes equal access of women and men to electoral mandates and elective functions, as well as to professional and social responsibilities.

2- Register
Article 1, paragraph 2
Public authorities, deliberative assemblies, directorates and hierarchies of public services, de jure, de facto, by delegation or circumstances, are constituted by the equal, joint, de jure, universal presence of both sexes.

26)- The historic effort
Parity seems complicated to acquire. On the other hand, the right to vote and formal equality seem to have been obvious, almost easy.
It is not so.

1- The unit
On April 21, 1944, General De Gaulle, co-chairman with General Giraud of the French Committee for National Liberation (CFLN), signed the order presented by the Consultative Assembly of Algiers: "Women are voters and eligible under the same conditions of man. ".
The MPs did not want it at the start. They rallied to the formula of the communist deputy Fernand Grenier.
De Gaulle was not a feminist. He signed on the spot.
Without this unity and the intellectual courage of these people who had been trained in the responsibilities of a contrary opinion, France would have missed the future.

2- The principle
On April 21, 2017, the Minister of Justice Christiane Taubira gave the way to conquer women's rights: “No, neither given nor granted, conquered! By generations of obstinate, ingenious, courageous, resistant women. Thank you."

27)- Conclusion
How long will women still be considered guests, even baggage?

It is time, it becomes urgent, that again, with a stroke of the pen, France will erase its past and dictate its future.
