CONTRIBUTION (47) TO THE NATIONAL DEBATE WANTED BY THE PRESIDENT OF THE REPUBLIC IN 2020.

REFLECTION (40) ON COMPENSATION FOR EXCESSIVE CONSEQUENCES OF LEGAL ACTIONS AND ON THE POLITICAL FUNCTION OF COMMUNITY LEADERS IN THE EXAMINATION AND EXPLOITATION OF THE OBSOLESCENCE OF COURT PROCEEDINGS.

PROPOSAL TO RESTORE THE MASTER OF THE STATE OVER JUDICIAL PROCEDURES;


The demonstrations which seize the occasion of the excessive consequences of legal actions of the police force multiply as well as their excesses.

It appears that the State has no legal procedure enabling it to control the political effects of these excessive and unforeseen consequences.

This obsolescence of the judicial procedures in force has led to an astonishing confrontation between the police and the Minister of the Interior. That is to say within the state.

Obviously, it is the ethno-religious political groups supported by an adventurous part of the political establishment who are leading the way.

However, as I have already explained, it is possible to:

1- Reclassify the main lines of these consequences.

2- Repair the wrongs thus made, without major costs for the Public Treasury.

3- Prevent the police from becoming political and judicial punching bags. 4- Let justice serve as a launching pad for the ambitious, the factious, and their policies of national division.

It is pitiful to see:

1- Police officers and gendarmes broken for legally exercising their public order function.

2- Judges play the watch knowing that they will have to leave the proceedings and the court from time to time in the hands of the families of criminals.

3- Statesmen sympathize at the bedside of an offender thus injured without meeting the police charged for a crime that does not exist.

I realize that no one has proposed anything relevant to this subject. I therefore take the liberty of recalling my reflections on this subject.
