INDEMNIFICATION (32) OF THE ADVISORS OF

The Chained Duck of Wednesday, June 12,
2019 publishes an article entitled "It sways a lot to Bercy! ",
P. 3.
The newspaper notes that the French
state had to change its doctrine regarding its relations to tax
advisers or informants.
Since 2017, the tax authorities have
been paying for information from tax advisers.
As in all cases in the form of
compensation, France is caught between the American ideal and the sad
reality of France.
a- In France, Mr. M. Sapin Minister of
Economy and Finance and Mr. Christian Eckert, Minister of Budget,
signed on May 10, 2017, before the installation of the new
government, a confidential circular limiting the "rewards"
of the advisers to one million euros.
b- In the United States, the fisc pays
"extravagant sums" according to Michel Sapin,
This is exactly the same logical
opposition evoked by the associations of victims in the case of
Servier known as the Picks. The humiliating stinginess on this side
of the Atlantic and the effective largesse on the other side.
The result is without appeal:
a- In 2004, the French Tax Department
was dependent on the German and English tax authorities to
obtain the transmission of a list of
French taxpayers who opened accounts in Liechtenstein.
b- In 2017, the informant who allowed
the largest recovery (€ 91.2 million) "only delivered part of
the tax evasion cases of which he was aware". according to the
deputy Christine Pirès Beaune.
The problem breaks down as follows:
1- Tax evasion involves tens of
billions of Euros.
2- The French State now recognizes the
merits of the compensation of the advisers.
3- Consequently, the rewards of the
advisers are of the order of the constitution of a capital.
4- The French State can not continue to
consider compensation as a tip tainted by immorality.
5- It can not either align with the
American regime.
The French report to public services,
public finances, and private businesses is not at all the same as in
the United States.
As the Ministers Sapin and Eckert have
suggested, the disbursement of capital sums by the Public Treasury
for private individuals would be perceived as a spoliation of the
Public Treasury.
6- The fact is that no one has so far
proposed even partial solution to connect the son of this skein.
Perennial solutions exist. They are the
result of the unusual use of routine and controlled procedures.
They come out of the notions of
Treasures, Magots, Lotto, and take into account the concern that the
State, and the French share, a good management of public funds.
It is indeed possible to reward the
advisers to the height of the financial stakes without spilling the
Public Treasury by acting jointly with the public and private
sectors.
This partnership is simple to put in
place. The Head of State could organize the experimentation. This is
the only way for something to happen and reach the attention of
Parliament.
One can also continue to play with
guilt and its opacities and find charm.
